These Terms and Conditions (“Terms”) govern all services, products, and agreements provided by D’Lux Closet (“Company,” “we,” “us”) to the client (“Client,” “you”). By engaging our services or accepting a proposal, you agree to these Terms in full.
1. Scope of Services
1.1 D’Lux Closet provides custom closet design, organization, restructuring, and installation services.
1.2 All services are outlined in a written proposal, contract, or estimate provided prior to commencement.
1.3 Services not included in the signed proposal or contract are considered additional services and will be quoted and billed separately.
2. Design Approval and Modifications
2.1 Clients must approve all design plans, materials, finishes, and pricing in writing prior to production or installation.
2.2 Once design approval is given, D’Lux Closet may proceed with production and installation without further modification unless agreed in writing.
2.3 Requests for changes after approval may incur additional fees and/or project delays.
3. Payment Terms
3.1 Payment is due according to the schedule in the proposal or contract.
3.2 A deposit or partial upfront payment may be required before work begins.
3.3 Final payment is due upon project completion and client sign-off.
3.4 Late payments may incur additional fees or interest as specified in the contract.
4. Client Responsibilities
Clients agree to:
- Provide accurate information, measurements, and preferences.
- Approve all plans, materials, and pricing prior to production.
- Ensure site accessibility for installation or assign an authorized representative.
- Communicate promptly regarding concerns during the design and installation process.
Failure to fulfill these responsibilities may affect project timelines or outcomes.
5. Workmanship and Material Warranty
5.1 D’Lux Closet guarantees professional workmanship and high-quality materials for 12 months from the date of completion.
5.2 Warranty covers installation or material defects only; it does not cover design choices, style, or aesthetic preferences.
5.3 Repairs or adjustments under warranty will be completed at D’Lux Closet’s discretion.
6. Intellectual Property
6.1 All design plans, drawings, 3D renderings, photographs, and related materials created by D’Lux Closet are the intellectual property of the Company.
6.2 Clients may not reproduce, distribute, or use these materials for purposes beyond their personal project without written consent from D’Lux Closet.
7. Limitation of Liability
7.1 D’Lux Closet is not liable for indirect, incidental, or consequential damages arising from services provided.
7.2 Total liability is limited to the amount paid by the Client for the project.
7.3 D’Lux Closet is not responsible for delays caused by circumstances beyond its control, including supplier delays, weather, or site accessibility issues.
8. Force Majeure
D’Lux Closet will not be liable for delays or failures due to events beyond its reasonable control, including acts of God, strikes, natural disasters, government actions, or supply chain disruptions.
9. Governing Law
These Terms are governed by the laws of the province or state in which services are performed.
Any disputes will be resolved in the courts with jurisdiction over the Company’s primary office.
10. Entire Agreement
These Terms, together with any written proposal, estimate, or contract, constitute the entire agreement between D’Lux Closet and the Client.
Any prior oral or written statements not included in the contract are superseded.
11. Acceptance of Terms
By engaging D’Lux Closet, approving a proposal, or signing a contract, the Client acknowledges that they:
- Have read, understood, and agreed to these Terms,
- Accept all responsibilities outlined, and
- Agree to the project scope and associated conditions.
